  • the Terms of use of www.laetitia.coach website between us (Laetitia Antonowicz) and you (User). See Article 1 for a definitions, and

ARTICLE 1 – LEGAL INFORMATION

 

1. Definitions

 

Coaching mean “a professionally guided process that inspires clients to maximise their personal and
professional potential. It is a structured, purposeful and transformational process, helping clients to see and test
alternative ways for improvement of competence, decision making and enhancement of quality of life. Coach and client work together in a partnering relationship on strictly confidential terms. In this relationship,
clients are experts on the content & decision making level; the coach is an expert in professionally guiding
the process
“. This is the definition used by the European Mentoring and Coaching Council, a professional body from which we are accredited.

 

Content refers to any text, images, PDFs, PowerPoints, video, audio or other materials on the Site.

 

Cookie. A cookie is a small file of letters and numbers that is downloaded on to your computer when you visit a website.

 

Cookie policy refers to the policy which governs how we use cookies in the Site.

 

Intellectual property rights mean all intellectual property rights in all forms, including applications for the registration and/or protection of these rights and non registered rights, including copyrights, design rights, trademarks, trade names, website marks.

 

Privacy policy refers to the policy which governs how we process any personal data collected from Users.

 

The Product/ Products and resource/resources mean the products and services to be supplied by us and as selected by you on our Website and sales pages, including “Your Next Life Chapter Self-Coaching Tool” and “Your Next Life Chapter +PLUS”, as well as free-of-charge self-coaching tool and resources.

 

Self-Coaching mean an approach to becoming more self aware and noticing patterns in one’s thoughts and behaviours. Self-coaching can be guided by questions and/or activities.

 

Terms refers to the terms and conditions of use of the Site.

 

We, us or our means Laetitia Antonowicz, self-employed under the legislation of England and Wales for activities related to professional and life coaching.

 

Our/The Website/ Site means all associated pages of the site www.laetitia.coach 

 

You or your means the User of the site and/or the Customer of a paid Product.

ARTICLE 2 – ACCESSIBILITY

2.1 The Site is in principle accessible to users 24/7, unless interrupted, scheduled or not, for maintenance purposes or in cases of force majeure.

 

2.2 In the event that access to the Site is not possible, the Site undertakes to do its utmost to restore access. The Site shall not be held liable for any damage, of any kind whatsoever, resulting from its unavailability.

 

2.3 This website is not aimed at young people below 16 years old.

 

 

ARTICLE 3 – Site ownership and Intellectual Property Rights

 

3.1 All text, images, and illustrations on the Website are our property unless specified otherwise. We hereby assert the right of intellectual property and author’s rights over this property: all use is forbidden except strictly personal use.

 

3.2 All reproduction of the Website, in whole or in part, and of the purchased Product(s) and free-of-charge resources is strictly forbidden without prior explicit authorisation.

 

3.3 We retain the intellectual property rights in any Product purchased on the Website or free resources downloaded or posted on our Website.

 

 

Article 4 = PERSONAL DATA AND GDPR

The User is informed that The Data Protection Act 2018 is the UK’s implementation of the General Data Protection Regulation (GDPR).

 

4.1 Persons responsible for collecting personal data

4.1.1 The person responsible for processing Personal Data is: Laetitia Antonowicz.

 

4.1.2 As the person responsible for processing the data it collects, Laetitia Antonowicz undertakes to comply with the legal provisions in force. In particular, it is the Client’s responsibility to establish the purposes of its data processing, to provide its prospects and customers, from the collection of their consents, with full information on the processing of their personal data and to maintain a register of processing in accordance with reality. Whenever Laetitia Antonowicz processes Personal Data, Laetitia Antonowicz takes all reasonable measures to ensure that the Personal Data is accurate and relevant to the purposes for which Laetitia Antonowicz processes it.

4.2 Purpose of the data collected

4.2.1 laetitia.coach may process all or part of the data:

  • to allow navigation on the Site and the management and traceability of the services and services ordered by the user: subscription to the newsletter/The Self-Coaching Minute, processing payment, invoicing, order history, etc.
  • to prevent and fight against computer fraud (spamming, hacking…): computer equipment used for browsing, IP address, password (hashed)
  • to improve navigation on the Site

 

4.2.2 Laetitia.coach does not sell your personal data, which is therefore only used for necessary processes and functions of the website.

 

4.3 Right of access, rectification and opposition

4.3.1 In accordance with GDPR regulations, Laetitia.coach users have the following rights:

 – right of access, updating, completeness of Users’ data right to block or delete Users’ personal data, when they are inaccurate, incomplete, ambiguous, outdated, or whose collection, use, communication or storage is prohibited

– right to withdraw consent at any time

– right to limit the processing of Users’ data

– right to object to the processing of Users’ data

– the right to the portability of the data provided by Users, when such data are processed automatically on the basis of their consent or a contract

– the right to define the fate of Users’ data after their death and to choose to whom Laetitia Antonowicz should communicate (or not) its data to a third party whom they have previously designated

 

4.3.2 As soon as Laetitia Antonowicz becomes aware of the death of a User and in the absence of instructions from him/her, Laetitia Antonowicz undertakes to destroy the data, unless their storage is necessary for evidential purposes or to meet a legal obligation.

 

4.3.3 If the User wishes to know how Laetitia Antonowicz uses his or her Personal Data, requests to rectify them or objects to their processing, the User may contact Laetitia Antonowicz in writing by recorded mail at the following address:

4.3.4 In this case, the User must indicate the Personal Data that he/she would like Laetitia Antonowicz to correct, update or delete, by identifying himself/herself precisely with a copy of an identity document (identity card or passport).

 

4.4.5 Requests for deletion of Personal Data will be subject to the obligations imposed on Laetitia Antonowicz by law, in particular with regard to the conservation or archiving of documents. Finally, Users of Laetitia.coach may file a complaint with the supervisory authorities, and in particular with the ICO Information Commissioner’s Office (https://ico.org.uk/)

4.4 Non-communication of personal data

4.4.1 Laetitia.coach will not process, host or transfer Information collected about its Users to a country outside the European Union or recognised as « not adequate » by the United Kingdom’s authorities. Nevertheless, Laetitia.coach remains free to choose its technical and commercial subcontractors on condition that they provide sufficient guarantees with regard to the requirements of the Data Protection Act 2018.

 

4.4.2 Laetitia.coach undertakes to take all necessary precautions to preserve the security of the Information and in particular that it will not be communicated to unauthorised persons.

 

4.4.3 However, if an incident affecting the integrity or confidentiality of Users’ Information is brought to Laetitia.coach’s attention, Laetitia.coach must inform the USer as soon as possible and inform him or her of the corrective measures taken.

 

4.4.4 Laetitia.coach does not collect any « sensitive data », that is data on race, ethnic background, political opinions, religious beliefs, trade union membership, genetics, biometrics, sexual orientation, health.

 

4.4.5 The User’s Personal Data may be processed by subsidiaries of Laetitia.coach and subcontractors (service providers, such as the payment platform Stripe) exclusively for the necessary purposes of Product purchase and payment processes.

4.5 Types of data collected

4.5.1 The Site collects the following data which are essential to the functioning of the website and the process of Products and services.

  • First name and email address for the subscription to the Newsletter/The Self-Coaching Minute.
  • First name, family name, address, phone number, email address, for the order, purchase and delivery of Products sold on the Resources page.
  • Bank cards information are handled by Stripe and we do not have access to this information. For more information on how Stripe handles personal data, refer to our Terms and Conditions of Sale and to www.stripe.com
  • First name and email address as well as responses to questions when booking a free-of-charge coaching consultation or a probono coaching session.

 

4.5.6 We undertake all expected and reasonable measures for the Website to be secure but we cannot fully guarantee the security of any information you submit to us or its confidentiality. You are therefore responsible for submiting only information that you do not regard as sensitive or highly confidential.

 

3.6 Data storage and retention

 

3.6.1 Data will not be kept longer than necessary at the end of a contractual relationship. Parameters are defined by law and include income tax and audit purposes, and handling complaints.

 

3.6.2.We periodically review the data we hold, and erase or anonymise it when we no longer need it.

 

 

ARTICLE 4 – COOKIE POLICY

4.1 The Laetitia.coach website may use « cookie » techniques to facilitate navigation and enable the process of order, purchase or payment.

 

4.2 In accordance with GDRP regulations, the Site has updated its privacy policy regarding cookies. The User is free to accept or reject cookies from the Site by modifying the settings of his or her web browser and by manually managing its parameters from the footer banner related to cookies.

 

4.3 We do not  use Cookies for managing traffic, length of sessions, IP address locations or page visited. We do not use Cookies for Google Analytics or WooCommerce Analytics.

 

Article 5 – Dispute resolution

 

5.1 If a dispute arises out of or in connection with these Terms that cannot be settled through our internal complaint mechanism, the parties will attempt to settle it by mediation as per Arbitration Act 1996.

 

5.2 Clause 5.1 does not hamper party’s freedom to commence legal proceedings.

 

5.3 Should a dispute arise between us, you agree not to engage in any disparaging communications against www.laetitia.coach, its representatives and/or employees, and its Products, content and services, orally or in writing, including on any social media platforms hosted in the United Kingdom or any other country.

 

ARTICLE 6 – APPLICABLE LAW AND JURISDICTION

This agreement and any dispute arising out of or in connection with it is governed by the laws of England and Wales.
